EXTENSION OF PROHIBITION TO DISMISS AND SUSPEND

Executive Decree No. 761/2020 published in the Official Gazette on September 24, 2020, extended the prohibition to dismiss without just cause and due to lack or reduction of work and force majeure, for 60 days, until November 25, 2020.

Likewise, the prohibition to suspend for reasons of force majeure or lack or reduction of work was extended for the same period, except for suspensions with payment of a non-remunerative assignment approved by the Administrative Authority (section 223 bis of the Labor Contract Law).

Dismissals and suspensions in violation of said prohibitions are void. Therefore, the existing labor relations and their conditions will remain in force.

Executive Decree No. 761/2020 is not applicable to employment contracts executed after September 26, 2020.

The prohibition to dismiss and suspend accumulates 240 days since it was implemented on March 31, 2020 (through Executive Decree No. 329/2020, extended by Executive Decrees No. 487/2020 and 624/2020).
